  • Login credentials, as well as geographic location data (if applicable)
  • Camera footage from the video surveillance system at the Qwiek office

  • QWIEK BV also automatically collects anonymous information regarding your use of the Website and QWIEK BV’s services via the Products and/or the App. For example, QWIEK BV will automatically log which sections of the Website, the Platform, and/or the App you visit, which web browser you use, and which website you visited when you accessed the Website. We cannot identify you based on this data, but it allows QWIEK BV to compile statistics regarding the use of the Website, the Platform, and/or the App.

The personal data collected by QWIEK BV is thus expressly and voluntarily provided by you.

Use of Personal Data

QWIEK BV may use your personal data for the following purposes:

  • Registering visitors when you visit the QWIEK BV offices
  • Creating and confirming an account
  • Fulfilling an agreement with QWIEK BV (including its follow-up)
  • Providing QWIEK BV’s services and/or products, whether or not through the Website and/or the App, and whether or not via a mobile device

Processing is carried out on the following legal grounds, as applicable:

Disclosure of Personal Data to Third Parties

QWIEK BV will not disclose your personal data to third parties, unless it is necessary in connection with the provision of QWIEK BV’s services and their optimization (such as, but not limited to, maintenance work, payment processing, the provision of services and/or products to QWIEK BV (e.g., through subcontracting), and database management). Notwithstanding the foregoing, however, QWIEK BV may disclose your personal data:

Your Privacy Rights

  • Right to access the personal data that QWIEK BV may hold about you;
  • The right to rectify, complete, or update your personal data;
  • Right to erasure of your personal data (“right to be forgotten”) (QWIEK BV would like to point out in this regard that certain services will no longer be accessible or available if you delete or have certain necessary personal data deleted);
  • Right to restrict the processing of your personal data;

To ensure that the request for access, correction, or deletion was made by you, we ask that you include a copy of your identification document with your request. In this copy, please black out your passport photo, MRZ (machine-readable zone, the strip of numbers at the bottom of the passport), passport number, and Citizen Service Number (BSN). This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks.

In addition, you can always update, change, and/or verify your personal data—which you were required to provide when creating your account—through your account.

Personal Data Security

QWIEK BV is committed to taking reasonable physical, technological, and organizational precautions to prevent (i) unauthorized access to your personal data, as well as (ii) the loss, misuse, or alteration of your personal data.

QWIEK BV will store all personal data it has collected in the cloud (with data center(s) located within the EU).

Notwithstanding QWIEK BV’s security policy, the controls it implements, and the measures it takes in this regard, a foolproof level of security cannot be guaranteed. No method of transmission or transfer over the internet, nor any method of electronic storage, is 100% secure; therefore, QWIEK BV cannot guarantee absolute security in this regard.

Finally, the security of your account will also depend in part on keeping your password confidential to access your account. QWIEK BV will never ask for your password, so you are required not to share it with anyone. If you do share your password with a third party, that third party will gain access to your account and your personal data using your password. In that case, you are personally liable for any actions taken through the use of your account. QWIEK BV therefore strongly recommends that, if you discover that someone has gained access to your account, you immediately change your password and contact us.

Cross-Border Processing of Personal Data

Any transfer of personal data outside the European Economic Area (EEA) to a recipient whose place of residence or registered office is in a country not covered by an adequacy decision issued by the European Commission will be governed by the provisions of a data transfer agreement, which will contain (i) the standard contractual clauses, as set forth in the “European Commission Decision of February 5, 2010 (Decision 2010/87/EC),” or (ii) any other mechanism based on privacy legislation or any other regulations concerning the processing of personal data.

Our website and/or service does not intend to collect data from website visitors under the age of 16, unless they have parental or guardian consent. However, we cannot verify whether a visitor is over 16 years of age. We therefore recommend that parents be involved in their children’s online activities to prevent data about children from being collected without parental consent.
